Vibe Check Customer Agreement

The Vibe Check is a limited-scope, remote interior design feedback service. Depending on the package purchased and the information you submit, a Vibe Check may include observations about style, visual balance, furniture arrangement, scale, color, lighting, decor, circulation, focal points, room function, product categories, and general next steps.

The exact scope, format, number of rooms, number of recommendations, included visuals, revision rights, delivery method, and estimated delivery window are those stated on the applicable product page, checkout page, intake form, or written order confirmation at the time of purchase.

A Vibe Check is not a full-service interior design engagement. Unless expressly stated in writing, it does not include site visits, field verification, measured drawings, construction documents, procurement, purchasing, order tracking, installation, project management, contractor coordination, permit services, or ongoing design consultation.

You are responsible for providing complete, accurate, current, and legible information, including photographs, videos, dimensions, floor plans, product information, budget, functional needs, household information, and known site conditions that may affect the recommendations.

You acknowledge that remote recommendations are based solely on the materials and information available to Veyah. Missing, inaccurate, distorted, outdated, incomplete, or misleading information may result in recommendations that are unsuitable, impractical, unsafe, visually inconsistent, or impossible to implement.

You must independently confirm all room dimensions, furniture dimensions, ceiling heights, door swings, window locations, clearances, electrical locations, plumbing locations, structural conditions, building restrictions, and product specifications before purchasing, installing, moving, mounting, or altering anything.

You represent and warrant that you own or have permission to submit all photographs, plans, videos, inspiration images, product images, text, and other materials you provide, and that Veyah may use those materials as necessary to provide the Vibe Check Services.

Veyah may use artificial intelligence, software tools, automated systems, templates, image-generation tools, or other technology to assist with analyzing submitted materials and preparing portions of a Vibe Check.

AI-generated or AI-assisted content is probabilistic and may be incomplete, inaccurate, inconsistent, non-unique, visually distorted, or based on incorrect assumptions. It may misread room geometry, scale, perspective, material appearance, furniture dimensions, door or window locations, circulation paths, or other conditions.

Veyah intends for each paid Vibe Check report to receive human review before delivery. Human review is intended to improve relevance and catch obvious issues, but it does not eliminate all errors, verify concealed or unreported conditions, replace field measurements, or guarantee that every recommendation is correct, safe, code-compliant, buildable, purchasable, or appropriate for your particular household.

You must use your own judgment and obtain appropriate professional review before relying on any recommendation that could affect safety, accessibility, construction, structure, electrical work, plumbing, code compliance, permanent installation, or significant expense.

The Vibe Check Services are intended for general interior styling, space-planning inspiration, and preliminary design guidance only. They are not architectural, engineering, structural, mechanical, electrical, plumbing, fire-protection, environmental, accessibility, legal, code, permitting, or construction services.

No Vibe Check deliverable is a measured drawing, permit document, bid document, construction document, installation instruction, or representation that a proposed layout or design complies with applicable laws, codes, lease restrictions, condominium rules, manufacturer requirements, accessibility standards, life-safety requirements, or building regulations.

Veyah does not inspect the property and cannot identify concealed conditions, structural limitations, hazardous materials, water intrusion, electrical hazards, unstable furnishings, mounting conditions, load limits, ventilation issues, egress concerns, child-safety risks, pet-safety risks, or other site-specific hazards.

Before implementing recommendations involving walls, ceilings, floors, built-ins, fireplaces, stairs, railings, windows, doors, lighting, electrical devices, plumbing fixtures, appliances, cabinetry, heavy objects, overhead objects, furniture anchoring, or construction, you must consult a qualified local professional and verify all requirements.

You should not rely on a suggested layout where exact clearances matter without verifying dimensions in the physical space. This includes circulation paths, accessible routes, door and drawer operation, appliance clearances, dining clearances, furniture spacing, fireplace clearances, and emergency egress.

Recommendations reflect professional opinion and aesthetic judgment, not an objective guarantee of outcome. Design preferences are subjective, and Veyah does not guarantee that you or any other person will like the final result.

Renderings, edited images, diagrams, mood boards, and other visuals are conceptual. They may not depict exact scale, color, texture, lighting, proportions, construction details, material transitions, or product appearance. Screen settings, photography, AI generation, and lighting conditions may alter how colors and materials appear.

Product references are informational and may include third-party products, affiliate links, approximate alternatives, or items that later change in price, specification, lead time, finish, availability, or shipping eligibility. Veyah does not guarantee product availability, quality, performance, delivery, compatibility, returnability, or merchant conduct.

You are solely responsible for reviewing product dimensions, materials, care requirements, warranties, return policies, delivery access, installation requirements, safety notices, and suitability before purchase.

Any included revision or follow-up right is limited to the scope stated at purchase. Unless otherwise stated, a revision means clarification or reasonable refinement of the existing recommendations and does not include a new room, new concept, substantially changed brief, additional deliverable, or redesign based on information not originally supplied.

Delivery dates are estimates and may be affected by incomplete intake information, technical issues, unusual project complexity, third-party service interruptions, or events outside Veyah's reasonable control.

You are responsible for monitoring the email address and account associated with your purchase and responding promptly to requests for missing information. Delays caused by incomplete or late responses may extend delivery.

You agree to pay all fees, taxes, and charges disclosed at checkout. By providing a payment method, you authorize Veyah and its third-party payment processors to charge that payment method for the purchase.

Because the Vibe Check is a customized digital service that may begin shortly after purchase, payments are non-refundable once review or preparation has begun, except where required by applicable law or expressly approved by Veyah in writing.

Refunds will not be provided solely because you disagree with a subjective design recommendation, decide not to implement the advice, encounter product unavailability, fail to provide complete information, or experience differences between a conceptual visual and the completed space.

If Veyah cannot provide the purchased service, Veyah may, at its discretion, issue a refund, credit, replacement service, or other reasonable remedy. This does not limit rights that cannot legally be waived.

Veyah retains all right, title, and interest in its platform, software, prompts, workflows, templates, report structure, branding, methodologies, visual systems, and other proprietary materials. Subject to payment and compliance with this Agreement, Veyah grants you a limited, personal, non-exclusive, non-transferable, revocable license to use your final Vibe Check deliverable for your own household or project.

You may share the deliverable with household members, contractors, installers, vendors, or other professionals involved in your project, but you may not resell, sublicense, publish as your own professional work, remove proprietary notices, use it to train an AI system, or commercially exploit it without Veyah's prior written permission.

You retain ownership of your original Customer materials. You grant Veyah a limited license to host, reproduce, process, adapt, and display those materials as reasonably necessary to provide, support, secure, and improve the Vibe Check Services, subject to the Privacy Policy.

Veyah processes personal information in accordance with its Privacy Policy. The Vibe Check Services may involve the collection and processing of contact information, payment-related information, room photographs, videos, floor plans, design preferences, household needs, product information, prompts, and communications.

Veyah may use third-party providers for hosting, payment processing, analytics, image storage, artificial intelligence processing, email, customer support, and related operations. Those providers may process information as described in the Privacy Policy and their applicable terms.

Do not submit highly sensitive personal information, confidential documents, visible financial records, government identification, access codes, medical records, or images of individuals who have not consented to being photographed or submitted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE VIBE CHECK SERVICES AND ALL DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VEYAH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, AND RESULTS.

Veyah does not warrant that the Vibe Check Services will be error-free, uninterrupted, compatible with every property or product, or that any recommendation will achieve a particular aesthetic, functional, financial, resale, safety, or other result.

You decide whether and how to implement any recommendation and assume the risks associated with purchasing products, moving furniture, mounting objects, hiring contractors, altering the property, or otherwise acting on the Vibe Check.

You are responsible for supervising any implementation and for selecting, vetting, contracting with, paying, and resolving disputes with contractors, installers, retailers, movers, tradespeople, or other third parties.

Veyah is not responsible for third-party acts or omissions, property damage, bodily injury, delays, cost overruns, product defects, installation errors, code violations, contractor performance, or purchasing decisions arising from implementation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEYAH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, LOSS OF USE, LOSS OF DATA, DIMINUTION IN PROPERTY VALUE, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE VIBE CHECK SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEYAH'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A VIBE CHECK WILL NOT EXCEED THE AMOUNT YOU PAID TO VEYAH FOR THE SPECIFIC VIBE CHECK GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the fullest extent permitted by law.

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Veyah and its affiliates, officers, directors, employees, contractors, licensors, service providers, successors, and assigns from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to: (a) your breach of this Agreement; (b) materials you submit; (c) your infringement of third-party rights; (d) your implementation or misuse of recommendations; (e) your failure to verify dimensions, conditions, codes, product specifications, or professional requirements; or (f) your negligence, fraud, or willful misconduct.

Veyah may suspend, refuse, or terminate the Vibe Check Services where reasonably necessary to address suspected fraud, abusive conduct, security risks, unlawful submissions, infringement, nonpayment, violation of the Platform Policies, or circumstances that make performance impractical or unsafe.

Termination does not affect accrued payment obligations or provisions that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and general provisions.

This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Any dispute arising out of or relating to this Agreement is subject to the dispute-resolution procedures in Veyah's Terms of Service. To the extent a court proceeding is permitted, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Cook County, Illinois.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY AGREES TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Notices. Legal notices to Veyah must be sent to Veyah Studio, 3835 N Ashland Ave, Apt 4N, Chicago, IL 60613, with a copy by email to support@veyah.studio where permitted by law.

Assignment. You may not assign this Agreement without Veyah's prior written consent. Veyah may assign it in connection with a merger, acquisition, reorganization, financing, or sale of assets.

Force Majeure. Veyah is not liable for delay or failure caused by events beyond its reasonable control, including outages, cyber incidents, natural disasters, labor disputes, governmental action, war, terrorism, epidemics, or failures of internet, hosting, AI, payment, or telecommunications providers.

Severability. If any provision is held invalid or unenforceable, the remaining provisions remain effective, and the affected provision will be enforced to the maximum extent permitted.

No Waiver. Failure to enforce a provision is not a waiver of future enforcement.

Entire Agreement. This Agreement and the incorporated Platform Policies constitute the entire agreement regarding the Vibe Check Services and supersede prior or contemporaneous communications on that subject.

Amendment. Veyah may update this Agreement by posting a revised version or providing notice. The version in effect when you purchase a Vibe Check will generally govern that purchase unless a change is required by law or expressly accepted by you.

By purchasing or accessing a Vibe Check, you acknowledge that you have read and agree to this Agreement; that the service is limited, remote, conceptual, and may use AI-assisted tools; that human review reduces but does not eliminate the possibility of incorrect design advice or poor layout guidance; and that you are responsible for verifying dimensions, conditions, safety, code requirements, and professional needs before implementation.
